व्याख्या
भारतीय संविधान के अनुच्छेद 32 के तहत सर्वोच्च न्यायालय (Supreme Court) और अनुच्छेद 226 के तहत उच्च न्यायालय (High Court) मौलिक अधिकारों के प्रवर्तन के लिए रिट जारी करते हैं। सर्वोच्च न्यायालय कुल 5 प्रकार की रिट जारी कर सकता है:
बंदी प्रत्यक्षीकरण (Habeas Corpus): किसी व्यक्ति को अवैध रूप से हिरासत में लिए जाने पर उसे न्यायालय के समक्ष प्रस्तुत करने का आदेश।
परमादेश (Mandamus): सार्वजनिक अधिकारियों को उनके कर्तव्य का पालन करने के लिए दिया जाने वाला आदेश।
प्रतिषेध (Prohibition): निचली अदालतों या न्यायाधिकरणों को उनके अधिकार क्षेत्र से बाहर जाने से रोकने के लिए।
उत्प्रेषण (Certiorari): निचली अदालतों द्वारा दिए गए आदेश को रद्द करने या मामले को उच्च न्यायालय में भेजने के लिए।
धिकारपृच्छा (Quo-Warranto): किसी व्यक्ति द्वारा सार्वजनिक पद के अवैध अधिग्रहण को रोकने के लिए।
