भारतीय संविधान में आपातकाल (Emergency) का प्रावधान जर्मनी के वाइमर (Weimar) संविधान से लिया गया है।
मुख्य बिंदु:
स्रोत: जर्मनी का संविधान (वाइमर संविधान)।
विशेषता: आपातकाल के दौरान नागरिकों के मौलिक अधिकारों के स्थगन (Suspension of Fundamental Rights) की शक्ति जर्मनी के संविधान से ही प्रेरित है।
संविधान में भाग: भारतीय संविधान के भाग XVIII (अठारह) में अनुच्छेद 352 से 360 तक आपातकालीन प्रावधानों का उल्लेख किया गया है।
