संवैधानिक प्रावधान: भारतीय संविधान के भाग XX (भाग
- 20) के अनुच्छेद 368 में संसद को संविधान और उसकी व्यवस्थाओं में संशोधन करने की शक्ति तथा उसकी प्रक्रिया का विस्तृत उल्लेख मिलता है।
संशोधन के प्रकार: इस अनुच्छेद के अंतर्गत मुख्य रूप से दो प्रकार की संशोधन प्रक्रियाओं का प्रावधान है:
संसद के विशेष बहुमत द्वारा (कुल सदस्यों का बहुमत और उपस्थित एवं मतदान करने वाले सदस्यों का दो-तिहाई बहुमत)।
विशेष बहुमत के साथ-साथ कम से कम आधे राज्यों के विधानमंडलों के अनुसमर्थन (Ratification) द्वारा।
स्रोत: संविधान संशोधन की यह प्रक्रिया दक्षिण अफ्रीका के संविधान से प्रेरित होकर भारतीय संविधान में जोड़ी गई थी।
