भारतीय संविधान के अनुच्छेद 169 में राज्यों में विधान परिषदों के सृजन (स्थापना) या उत्सादन (समाप्ति) से संबंधित प्रावधान दिए गए हैं।

यदि किसी राज्य की विधानसभा अपने कुल सदस्यों की संख्या के बहुमत तथा उपस्थित और मतदान करने वाले सदस्यों के कम से कम दो-तिहाई बहुमत से एक संकल्प (प्रस्ताव) पारित करती है, तो संसद उस राज्य में विधान परिषद का सृजन या उत्सादन कर सकती है।
भारतीय संविधान के अनुच्छेद 168 के अनुसार राज्य के विधानमंडल का गठन विधानसभा, विधान परिषद (जहाँ यह अस्तित्व में है) और राज्यपाल से मिलकर होता है।
अनुच्छेद 170 विधानसभा की संरचना से संबंधित है।
