मौलिक अधिकारों के प्रवर्तन के लिए भारतीय संविधान के अंतर्गत कुल 5 प्रकार की रिट (Writs) जारी की जा सकती हैं।
मुख्य बिंदु:
संवैधानिक उपचार: भारतीय संविधान के अनुच्छेद 32 के तहत उच्चतम न्यायालय (Supreme Court) और अनुच्छेद 226 के तहत उच्च न्यायालयों (High Courts) को मौलिक अधिकारों की रक्षा के लिए रिट जारी करने की शक्ति प्राप्त है।
पाँच प्रकार की रिट:
बंदी प्रत्यक्षीकरण (Habeas Corpus): किसी अवैध रूप से हिरासत में लिए गए व्यक्ति को न्यायालय के समक्ष प्रस्तुत करने के लिए।
परमादेश (Mandamus): किसी सार्वजनिक अधिकारी या निकाय को उसके कर्तव्य का पालन करने के लिए आदेश देना।
प्रतिषेध (Prohibition): निचली अदालतों या अर्ध-न्यायिक निकायों को उनके अधिकार क्षेत्र से बाहर जाने से रोकना।
उत्प्रेषण (Certiorari): किसी मामले में निचली अदालत के निर्णय को रद्द करने या उसे उच्च न्यायालय में भेजने का आदेश।
धिकारपृच्छा (Quo-Warranto): किसी व्यक्ति द्वारा अवैध रूप से सार्वजनिक पद ग्रहण करने पर उसकी वैधता की जाँच करना।
