संविधान के अतिक्रमण (Violation of the Constitution) के लिए भारत के राष्ट्रपति पर महाभियोग (Impeachment) चलाने का आरोप संसद के किसी भी सदन द्वारा लगाया जा सकता है।
महाभियोग की प्रक्रिया से संबंधित प्रावधान संविधान के अनुच्छेद 61 में दिए गए हैं:
आरोप संसद के किसी भी सदन (लोकसभा या राज्यसभा) में प्रस्तुत किया जा सकता है।
इसके लिए सदन के कुल सदस्यों के कम से कम एक-चौथाई (1/4) सदस्यों के हस्ताक्षर वाला प्रस्ताव लाना होता है और राष्ट्रपति को 14 दिन पूर्व लिखित नोटिस देना पड़ता है।
यदि वह सदन अपने कुल सदस्यों के कम से कम दो-तिहाई (2/3) बहुमत से प्रस्ताव पारित कर देता है, तो आरोप दूसरे सदन में भेजा जाता है, जो इसकी जांच करता है।
