संवैधानिक प्रावधान: संविधान के अनुच्छेद 243-U के अनुसार, प्रत्येक नगरपालिका का कार्यकाल उसके पहली बैठक के लिए नियत तिथि से 5 वर्ष का होता है।
चुनाव की समय-सीमा: नगरपालिका के विघटन की स्थिति में या उसका कार्यकाल पूरा होने से पहले (अर्थात कार्यकाल समाप्त होने की तिथि से पूर्व ही) नए चुनाव संपन्न करा लिए जाने चाहिए ताकि स्थानीय प्रशासन में कोई व्यवधान न आए।
विघटन पर: यदि नगरपालिका का समय से पहले विघटन होता है, तो विघटन की तारीख से 6 महीने की अवधि के भीतर चुनाव कराना अनिवार्य होता है।
