भारतीय संविधान का अनुच्छेद 22 कुछ मामलों में गिरफ्तारी और निरोध से संरक्षण प्रदान करता है।
मुख्य बिंदु:
यह अनुच्छेद किसी भी व्यक्ति को जो गिरफ्तार किया गया है, उसे गिरफ्तारी के कारणों से अवगत कराने का अधिकार देता है।
गिरफ्तार व्यक्ति को अपनी पसंद के कानूनी व्यवसायी (वकील) से परामर्श करने और बचाव करने का मौलिक अधिकार प्राप्त है।
इसके तहत यह भी अनिवार्य किया गया है कि गिरफ्तार व्यक्ति को 24 घंटे के भीतर (यात्रा के समय को छोड़कर) निकटतम मजिस्ट्रेट के समक्ष पेश किया जाए।
यह सुरक्षा प्रावधान कुछ विशेष परिस्थितियों जैसे निवारक निरोध (Preventive Detention) के मामलों में कुछ सीमाओं के अधीन होते हैं।
