- (1) के अनुसार, किसी राज्य की विधान परिषद (Legislative Council) के सदस्यों की न्यूनतम संख्या 40 होनी चाहिए।

न्यूनतम सीमा: विधान परिषद राज्य विधानमंडल का उच्च सदन होता है, और इसके सदस्यों की संख्या उस राज्य की विधानसभा (Legislative Assembly) के कुल सदस्यों की संख्या के एक-तिहाई से अधिक नहीं हो सकती, साथ ही यह किसी भी स्थिति में 40 से कम नहीं हो सकती (जम्मू-कश्मीर इसका अपवाद था जब वह राज्य था)।
संरचना: यह एक स्थायी सदन है जिसके सदस्यों का कार्यकाल 6 वर्ष होता है और इसके एक-तिहाई सदस्य प्रत्येक दो वर्ष बाद सेवानिवृत्त होते हैं।
