भारतीय संविधान के अनुच्छेद 243-E के अंतर्गत पंचायतों के कार्यकाल का प्रावधान किया गया है।
73वें संविधान संशोधन अधिनियम के अनुसार, प्रत्येक पंचायत अपनी पहली बैठक के लिए नियत तिथि से 5 वर्ष की अवधि तक बनी रहती है, बशर्ते उसे इससे पहले विधि के अनुसार समय से पूर्व विघटित (Dissolve) न किया जाए।
यदि 5 वर्ष का कार्यकाल पूरा होने से पहले पंचायत का विघटन होता है, तो विघटन की तिथि से 6 महीने की अवधि के भीतर नए चुनाव कराना अनिवार्य होता है।
