वर्ष 1992 में पारित 73वें संविधान संशोधन अधिनियम द्वारा संविधान में नया भाग IX जोड़ा गया, जिसने पंचायती राज व्यवस्था को संवैधानिक दर्जा दिया।
इस संशोधन के अनुच्छेद 243D
- (3) के अनुसार, पंचायतों में सभी स्तरों पर प्रत्यक्ष निर्वाचन द्वारा भरी जाने वाली कुल सीटों में से कम से कम एक-तिहाई (33%) सीटें महिलाओं के लिए आरक्षित होना अनिवार्य किया गया है।
कुछ राज्यों ने अपने यहां कानून बनाकर महिलाओं के लिए इस आरक्षण को बढ़ाकर 50% तक भी कर दिया है, लेकिन संविधान द्वारा निर्धारित न्यूनतम अनिवार्य सीमा 33% (एक-तिहाई) है।
